Form 5 – Entry Notice

Form 5 – Entry Notice is the official Residential Tenancy Authority approved form that is completed by the property manager and given to the tenant to advise of the intention to enter the property on a certain date and time. Entry must be between 8am and 6pm, Monday to Saturday. Should entry be required outside these hours such as a Sunday or public holiday, the tenant must agree.

The property manager or a contractor can only enter a property for a valid reason and if the correct notice period has been provided to the tenant. An entry notice is not required when in an emergency, property manager believes entry is necessary to protect the property from damage about to happen or if the tenant verbally agrees with the entry.

Below is a list of reasons for entry and timeframe requirements:

Routine Inspections – The tenant must be provided with a minimum of 7 days’ notice and not within 3 months of previous entry. Maximum of 4 routine inspections per year

Routine Repairs and Maintenance – The tenant must be provided with at least 24 hours

Smoke Alarm / Safety Switch – Should smoke alarms and safety switches need to be installed or carry out repairs/maintenance the tenant must be provided with at least 24 hours

To show a prospective purchasers or tenant – The tenant must agree to all open home inspections. For a private inspection, the tenant can not decline entry unless there is a valid reason. The tenant must be provided at least 24 hours and reasonable time has lapsed since last entry for the same reason

Valuation – The tenant must be provided with at least 24 hours

Suspected Abandonment – The property manager must have reasonable grounds for believing the property has been abandoned. The property manager can issue an entry notice to confirm it has been abandoned, by providing the tenant with at least 24 hours’ notice

Inspect/Check if the tenant ha remedied a significant breach – The tenant must have been breached for the property manager to reinspect the property. The tenant must be provided with at least 24 hours’ notice, and must be within 2 weeks of the expiry of the Notice to Remedy Breach.
